Challenge To Unigene’s Osteoporosis Patent Among The Reexamination Requests Week Of 6/20/11

Unigene Laboratories obtained a judgment in 2009 against Apotex for infringement of Unigene’s Reissue Patent No. 40,812 coveringUnigene’s FORTICAL® formulation for treatment of postmenopausal osteoporosis.  The only significant issue in that case appears to have been patent validity.  The case is on appeal to the CAFC.  This past Wednesday, reexamination was requested for the ‘812 patent, presumably by Apotex, though the PTO records are not yet clear (see inter partes Request No. (2)).

Reexamination was requested for another Hydro-Quebec lithium battery, but the PTO records don’t yet disclose which one (see inter partes Request No. (3)) – Hydro-Quebec has at least five. (more…)

Apple Attack On MONKEYmedia Audiovisual Patent, Among The Reexamination Requests Filed Week Of May 16, 2011

Last December, Apple defended itself against MONKEYmedia’s patent infringement allegations in the Western District of Texas, by requesting reexamination of two of MM’s streaming media patents-in-suit.  Applehas now sought reexamination of a third MM patent-in-suit (see inter partes Request No. (10)).

Reexamination was also requested by Xilinx for a circuits patent owned by Intellectual Ventures, but it is not clear from the PTO files whether the IV patent is the subject of any infringement litigation (see inter partes Request No. (8)).

And SemiLEDs Corporation has requested reexamination of a Group III nitride LED patent owned by Cree (see inter partes Request No. (7)). The companies are currently in litigation in the Middle District of North Carolina over that patent and four others. (more…)

RIM Challenge of Two SimpleAir Patents Among the Reexamination Requests Filed Week of 5/9/11

Here is the latest installment of Reexamination Requests from Scott Daniels, of Reexamination Alert and Practice Center Contributor….

RIM has requested reexamination of SimpleAir’s U.S. Patent Nos. 6,021,433 and 6,735,614 that claim contact alerts for incoming messages (see ex parte Request No. (15) & inter partes Request No. (5)).  SimpleAir has accused Apple, RIM, Facebook and a number of others in the Eastern District of Texas of infringement of the ‘614 and ‘433 patents, as well as two other patents.

The week also saw yet another round in the war between Abbott Diabetes Care and DexCom over analyte sensors (see ex parte Request No. (5)).

And Square, Inc. requested reexamination of three REM Holdings patents for reader cards for cell phones (see inter partes Request Nos. (2), (3) & (4)), which are the subject of an infringement dispute between those companies in the Eastern District of Missouri. (more…)

Micro-Probe Attack On FormFactor Electrical Connection Patent Among Reexamination Requests Filed Week Of 4/18/11

Here is the latest installment of Reexamination Requests from Scott Daniels, of Reexamination Alert and Practice Center Contributor….

Micro-Probe has requested reexamination of FormFactor’s U.S. Patent No. 7,225,538 that claims methods for making electrical connections in semiconductor packaging assemblies (see inter partesRequest No. (11)). FormFactor has sued Micro-Probe in the Northern District of California for infringement of the ‘538 patent, as well as for infringement of six other patents and for a series of trade secret-type violations.  The PTO has ordered reexamination for five of thoseFormFactor patents, and Micro-Probe has moved Judge Phyllis Hamilton for a partial stay of the District Court case.  The ‘538 was the subject of an ITC investigation in 2009 that ended in a determination of no infringement by the importers.

The clear winner last week for the number of requests filed was Vesdia that sought reexamination of four TuitionFund patents related to merchant rebates and college tuition (see inter partes Request Nos. (1), (3), (5) & (6)).  The two companies are in litigation in Tennessee over those patents.

After requesting reexamination for a Hisamitsu transdermal adhesive patent three weeks ago, Kowa has now requested reexamination of a second Hisamitsu patent, this one claiming transdermal patches (see inter partes Request No. (2)). (more…)

Challenges To Two MobileMedia Ideas Patents, Among The Reexamination Requests Filed Week Of 4/11/11

Here is the latest installment of Reexamination Requests from Scott Daniels, of Reexamination Alert and Practice Center Contributor….

Reexamination was requested for two MobileMedia Ideas patents.  PTO dockets show that RIM filed one of the requests, but are unclear about who filed the second, though that request was quite likely filed by RIM as well (see ex parte Request Nos. (3) & (13)).  MobileMedia has sued RIM for infringement of these patents in the Eastern District of Texas.

A very important request, reported in a parallel post today, is Google’s second request for reexamination of an Oracle patent (see ex parteRequest No. (20)).

Abbott Diabetes Care has requested reexamination of two DexComanalyte sensor patents (see ex parte Request Nos. (8) & (18)).
