Kyocera Challenge to ADC Personal Communicator Patent Among the Reexamination Requests Filed the Week of May 7, 2012

Here is our latest weekly installment of Reexamination Requests from Scott Daniels, of Reexamination Alert and Practice Center Contributor…

This past Friday, Kyocera requested reexamination of an ADC Technology patent – U.S. Patent No. 6,985,136 – for a “personal communicator,” i.e., a portable computer for wireless data transmission (see inter partes Request No. (4)).  ADC is currently pursuing an infringement action against Kyocera in Illinois.  The ‘136 patent survived an earlier reexamination attempt, with the patentability of all claims confirmed.

Axis Communications requested reexamination of two Walker Digital Internet surveillance patents (see ex parte Request Nos. (13) & (14)).  The companies are currently involved in an infringement action in Delaware regarding the patents.

The following inter partes requests were filed:

(1) 95/001,984 (electronically filed) – U.S. Patent No. 7,835,757 entitled SYSTEM AND METHOD FOR DELIVERING INFORMATION TO A TRANSMITTING AND RECEIVING DEVICE and owned by Helferich Patent Licensing.  Filed May 9, 2012, byCBS Interactive and six other entities.  The ‘757 patent is currently the subject of 12 infringement actions.

(2) 95/001,985 (electronically filed) – U.S. Patent No. 8,066,875 entitled FLASH CHROMATOGRAPHY CARTRIDGE and owned by Scientific Plastic Products.  Filed May 10, 2012, byBiotage AB.  The ‘875 patent is currently the subject of a litigation styled Scientific Plastic Products v. Biotage AB (Case No. 3:11-cv-2778 (S.D. Cal.)).

(3) 95/001,986 (electronically filed) – U.S. Patent No. 8,070,957 entitled FLASH CHROMATOGRAPHY CARTRIDGE and owned by Scientific Plastic Products.  Filed May 10, 2012, byBiotage AB.  The ‘957 patent is currently the subject of a litigation styled Scientific Plastic Products v. Biotage AB (Case No. 3:11-cv-2778 (S.D. Cal.)).

(4) 95/001,987 (electronically filed) – U.S. Patent No. 6,985,136 entitled PORTABLE COMMUNICATOR and owned byADC Technology.  Filed May 11, 2012, by Kyocera.  The ‘136 patent is currently the subject of a litigation styled ADC v. Kyocera (Case No. 10-cv-3938 (N.D. Ill.)).

(5) 95/001,988 (electronically filed) – U.S. Patent No. entitled PRE-LOADED NEEDLE ASSEMBLY and owned byWorldwide Medical of Florida.  Filed May 11, 2012.

(6) 90/012,289 (electronically filed) – U.S. Patent No. 6,521,551 entitled MODIFIED SHUSS KNITTED NETTING and owned by Tama Plastic Industry.  Filed May 8, 2012.   The ‘551 patent is currently the subject of a litigation styled Tama Plastic Indus.
