Apple Reexamination Requests Of Two VirnetX Patents Among Those Requested Week Of 10/17/11

Apple has requested reexamination of two more VirnetX network protocol patents – U.S. Patent Nos. 7,418,504 and 7,921,211 (see inter partes Request Nos. (2) & (3)).  VirnetX has sued Apple and several others for infringement of the ‘504 and ‘211 patents, as well as four other related patents.  Three of the other VirnetX patents-in-suit are in reexamination, and a fourth emerged from reexamination earlier this year with the validity of its claims confirmed.

CSR Technology has requested reexamination of two Bandspeed patents claiming methods for selecting communications channels based on use, in products such as computers and mobile telephones.  (see inter partes Request Nos. (5) & (6)).  Bandspeed has sued 38 companies for infringement of the patents, among them Acer, Dell, HP, HTC, Kyocera, LG, RIM and Samsung. (more…)

HTC Claims Intervening Rights Against Apple In ITC Case

Scott Daniels, Partner at Westerman, Hattori, Daniels & Adrian and Practice Center Contributor, sent in this article discussing the pending ITC investigation of HTC’s mobile communication devices.  Daniels raises interesting questions regarding HTC’s latest motion asking the ITC  for a determination that it does not infringe one of Apple’s patents because it’s entitled to “absolute intervening rights” against Apple.

HTC might be making a comeback in the ITC’s investigation of mobile communication devices  (337-TA-710).  In July Administrative Law Judge Charneski issued an Initial Determination (ID) against HTC, finding that its accused communication devices infringe two data manipulation patents owned by Apple.  That determination, if affirmed by the full Commission, would likely result in exclusion from entry into the United States of HTC’s infringing devices.

But in September the full Commission announced that it was reviewing Judge Charneski’s ID against HTC.  And, in a step that will interest reexamination practitioners, HTC asked the ITC for a determination that it does not infringe one of the Apple patents – U.S. Patent No. 5,946,647 – because HTC is entitled to “absolute intervening rights” created in a co-pending reexamination of Apple’s ‘647 patent. Requests For Reexamination Of Four Round Rock Patents Among Those Filed Week of 9/12/11

Requests for reexamination were filed against four RFID patents owned by patent-holding/enforcement company Round Rock Research (see ex parte Request Nos. (1), (2), (4), & (5)).  The requests do not indicate who filed them, and the patents does not appear to be the subject of pending litigation, raising the prospect of a party simply targeting Round Rock patents.Rou

Earlier this year, Universal Electronics sued Logitech in the Central District of California for infringement of three touch-pad patents. Logitech has now replied by seeking reexamination of those patents (see inter partes Request Nos. (7), (8) & (9)).

GoogleApple and Quattro teamed up to request reexamination of a StreetSpace patent for online advertising (see inter partesRequest No. (10)).  The parties are currently in litigation over that patent in the Southern District of California.

And yet another reexamination request was filed in the long, on-going war between Abbott Diabetes Care and DexCom over analyte measuring devices (see ex parte Request No. (9)). (more…)

Request For Reexamination Of 3M Lithium-Ion Battery Patent Among Those Filed Week Of 7/25/11

An unidentified party has sought reexamination of 3M’s U.S. Patent No. 7,078,128 for cathode compositions for lithium-ion batteries (see ex parte Request No. (10)).  The ‘128 patent was the subject of an ITC investigation against Sony and others in 2007, which ended in settlements.  No reexamination has yet been requested against3M’s U.S. Patent No. 6,964,828 that was also in the ITC’s investigation.

In March Google requested reexamination U.S. Patent No. 6,981,040 in response to an infringement allegation by the ‘040 patentee, Personalized User Model (PUM).  Now, Google has requested reexamination of U.S. Patent No. 7,685,276 (see inter partes Request No. 3), the other PUM patent-in-suit.

Requests were also filed against three Hewlett-Packard patents for circuits and switches (see ex parte Request Nos. (11), (12) & (13)). (more…)

YouTube Attacks On Pragmatus’s Media File Storage Patents Among Reexamination Requests Filed Week Of 6/6/11

Here is the latest installment of Reexamination Requests from Scott Daniels, of Reexamination Alert and Practice Center Contributor….

Earlier this year, Pragmatus sued Facebook, LinkedIn, Photobucket, and YouTube for infringing three patents for systems for storing media files.   YouTube has now requested reexamination of those patents (see inter parte Request Nos. (6), (8) & (9)).

Apple has requested reexamination of Softview’s U.S. Patent No. 7,831,926 related to systems for “zooming and panning” images from the Internet on mobile devices.  Softview has sued Apple and AT&T Mobility in Delaware for infringing the ‘926 patent.  Softview is also involved in a separate case with HTC in Washington state regarding the ‘926 patent.

IDT requested reexamination of Alexsam’s U.S. Patent No. 6,000,608 which relates to activation of “stored value” card (see ex parte Request No. (3)). In February, Alexsam won a $9.06 million jury verdict against IDT in the Eastern District of Texas for infringement of the ‘608 patent and a second patent. (more…)
